General Terms and Conditions of Sale

1. General Information

These General Terms and Conditions regulate the use of the webshop operated by OPG CACTUS, Franjo Lovreković, located at Petra Preradovića 17, 33405 Pitomača, Croatia (hereinafter referred to as “the Seller”). By accessing or purchasing from our website, the Customer accepts these terms.

2. Product Availability and Unique Items

Each plant listed as a single item in stock (quantity: 1) represents the exact plant shown in the photo. These are unique specimens. Adding such an item to your cart does not guarantee reservation or purchase. The plant is considered sold only after the order is completed and payment is successfully received.

Please double-check your cart before finalizing the purchase. We cannot guarantee availability if another customer completes the purchase before you.

3. Order Processing and Shipping

  • Due to the provisions of the CITES (Convention on International Trade in Endangered Species), plants can only be shipped within the European Union.

  • Each plant is shipped with an accompanying Plant Passport.

  • For shipping outside the EU, CITES import and export permits are required and the entire process can take more than a month. I ask all interested parties to contact me before purchasing.

  • Seeds from CITES Appendix II can be shipped internationally with the attached Phytosanitary Certificate.
  • The Phytosanitary Certificate is available in our store: LINK
  • The price is 19.00 EUR and is valid for one shipment regardless of the quantity of seeds ordered.
  • Orders without an attached Phytosanitary Certificate are solely at the buyer’s risk. We are not responsible for any customs problems.
  • Please check your country’s customs regulations.

  • Handling time: 5–7 business days from the date of payment receipt.

  • All plants are shipped bare root (without pots or substrate). Roots are cleaned and may be trimmed for safe transport.
  • During shipping, plants may shrink or dehydrate, which can temporarily reduce their size. This is normal and not harmful.

All shipments are sent via Hrvatska Pošta as “Recommended Priority Airmail” with tracking. EMS is available upon request.

Estimated Delivery Times (may vary): 3–20 days, depending on the destination and customs procedures.

Tracking: You can track your shipment via the official Croatian Post website, your national postal service, or third-party tracking services.

4. Shipping Costs

Domestic (Croatia) Shipping Rates:

  • Plants: 5.00€ (flat rate)
  • Seeds only: 3.00€ (flat rate)
  • Plants + Seeds: 5.00€ (flat rate) Seeds shipping is free; standard plant shipping applies.

European Union (EU) Shipping Rates:

  • Plants: 15.00€ (flat rate)
  • Seeds only: 6.00€ (flat rate)
  • Plants + Seeds: 15.00 (flat rate) Seeds shipping is free; standard plant shipping applies.

International Shipping Rates:

  • Seeds: 6.00€ (flat rate)

The minimum order value, excluding shipping costs, is €15.00.

5. Prices and Payment Methods

All prices are in Euros (EUR). We accept the following payment methods:

  • Credit and debit cards
  • PayPal
  • Apple Pay
  • Google Pay

Payment must be completed in full before order processing begins.

6. Right of Withdrawal / Returns

In accordance with EU consumer protection laws, customers generally have the right to withdraw from the contract within 14 days of delivery. However, this right does not apply to perishable or living goods like live plants, as they deteriorate quickly or are sensitive to handling and environmental changes.

Therefore, returns of live cactus plants are not accepted, except in cases of transport damage, which must be reported within 48 hours of receipt, with photo evidence.

Seed packets are eligible for withdrawal if unopened and returned in original condition. The return shipping cost is borne by the customer.

7. Contract Conclusion

A purchase contract is concluded once the customer successfully completes checkout and receives a confirmation email. The Seller reserves the right to cancel the order in case of stock errors, payment issues, or suspected misuse.

8. User Accounts

Registered users must provide accurate, complete information. The Seller reserves the right to suspend or delete accounts suspected of misuse or fraud.
